Patent, Copyright, Internet, Et Alia

After months of negotiation between the Council of Fashion Designers of America (CFDA) and the American Apparel and Footwear Association (AAFA), an agreement was reached regarding the scope of copyright protection for fashion designs.  However, the AAFA board rejected the compromise bill last week, leaving the CFDA as the chief proponent of the Design Piracy Prohibition Act.

Peter Gabbe, AAFA chairman, explained: “When we considered the risk and reward ratio, the unintended consequences were untenable.”

Steven Kolb, CFDA executive director, responds: “We have invested a lot of energy and time into this. We are not abandoning this legislation. We are comfortable and glad that we went through the process because we have a tighter and stronger bill.”

Some believe that the “CFDA has only a small chance at getting the bill to reach a vote in Congress without the support of the AAFA.”

The bill is still in committee. Stay tuned.
