Copyright in fashion design?

The Design Piracy Prohibition Act (H.R. 2033 and S. 1957) pending before Congress would provide three years of design protection to fashion designs. Interestingly, the Act requires the Register of Copyrights to examine the application and determine if, on its face, it meets the subject matter requirement that it be an original design.
